Terms of Service

These Terms of Service ("Terms") govern your access to and use of madamezuzus.com and any related services, features, and content (collectively, the "Site") operated by Madame Zuzu's Tea House & Record Shop ("Madame Zuzu's," "we," "us," or "our"), located in Highland Park, Illinois, USA. By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order. By using the Site you represent that you meet this requirement and that all information you provide is accurate.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

3. Products, Pricing & Availability

We sell teas, vinyl records, apparel, and other merchandise. Product descriptions, images, prices, and availability are subject to change without notice. Vinyl is sourced from independent suppliers and quantities are limited; once sold out, items may not be restocked.

We make reasonable efforts to display products accurately, but we do not warrant that descriptions, colors, packaging, or other content are error-free. In the event of a pricing or availability error, we reserve the right to cancel any order, even after confirmation.

4. Orders & Payment

Orders are subject to acceptance. We may refuse or cancel any order at our discretion, including for suspected fraud, resale, pricing errors, or inability to ship. All payments are processed through Shopify Payments / Shop Pay. By submitting payment information, you authorize us (or our processor) to charge the total order amount, including taxes and shipping.

Saved carts persist for up to 14 days from the most recent activity; abandoned carts are cleared automatically after that window. Currency is U.S. Dollars (USD) unless otherwise indicated.

5. Shipping & Delivery

Domestic (U.S.): Free standard shipping on orders over $150. Orders typically ship within 2–5 business days.

International: Shipping rates are calculated at checkout. The recipient is responsible for any import duties, taxes, customs fees, or brokerage charges levied on delivery. Delivery times vary by destination and customs processing. Risk of loss passes to you upon delivery to the carrier.

6. Returns & Refunds — Final Sale

All sales are final. We do not accept returns or issue refunds except as required by law or if an item arrives damaged, defective, or materially different from what was ordered.

If your order arrives damaged or incorrect, contact cafe@madamezuzus.com within 7 days of delivery with photos. We will arrange replacement, repair, or refund at our discretion. This policy does not affect any non-waivable statutory rights you may have under applicable consumer law (including, where applicable, the EU Consumer Rights Directive).

7. Events & Tickets

Tickets to events at Madame Zuzu's are non-refundable unless the event is canceled by us. Private event bookings are governed by a separate agreement provided through Tripleseat. By attending an event you consent to being photographed or recorded for promotional use.

8. Intellectual Property

All content on the Site — including text, graphics, logos, photos, audio, video, and software — is the property of Madame Zuzu's or its licensors and is protected by U.S. and international copyright, trademark, and other laws. You may not copy, reproduce, distribute, modify, or create derivative works without our prior written permission, except for personal, non-commercial use.

9. User Content

If you submit reviews, photos, comments, or other content, you grant Madame Zuzu's a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license to use, reproduce, display, and distribute that content in connection with our business. You represent that you own or have rights to the content and that it does not infringe any third party's rights.

10. Prohibited Uses

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to any portion of the Site, accounts, or systems.
• Scrape, mirror, or reproduce the Site or its content for resale or commercial use without consent.
• Interfere with the Site's operation, security, or other users' enjoyment.
• Place orders for resale without prior written authorization.
• Submit false, misleading, infringing, or harassing content.

11. Disclaimer of Warranties

The Site and all products are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, except as required by applicable law.

12. Limitation of Liability

To the fullest extent permitted by law, Madame Zuzu's and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill arising from or related to your use of the Site or any product. Our total aggregate liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Madame Zuzu's and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Lake County, Illinois, and you consent to personal jurisdiction there. Nothing in this section limits any non-waivable rights you may have under your local consumer-protection laws.

15. Truth in Advertising

We make commercially reasonable efforts to ensure marketing claims comply with the U.S. Federal Trade Commission Act. Tea descriptions reflect supplier information; statements regarding tea or wellness benefits have not been evaluated by the FDA and are not intended to diagnose, treat, cure, or prevent any disease.

16. Termination

We may suspend or terminate your access to the Site at any time, without notice, for any reason, including violation of these Terms.

17. Changes to These Terms

We may modify these Terms at any time. The "Effective" date will reflect the latest revision. Continued use of the Site after changes constitutes acceptance of the updated Terms.
